Terms of Service

This is an English translation provided for convenience. If it differs from the Turkish original, the Turkish version prevails.
1. Parties and scope
These terms are between Cevdet Aslan ("Tapiko", "we") and everyone who uses tapiko.app, the Tapiko card customers open in their browser, the business dashboard or the Tapiko mobile app (together, the "Platform") ("you"). By opening an account or using the Platform you accept these terms. A person who opens an account on behalf of a business declares that they are authorized to bind that business.
2. Definitions
- Business: a café, bakery, salon or similar shop that runs a loyalty program on the Platform.
- Customer: a person who collects stamps on a business's card.
- Staff: a person the business invites to the dashboard; their role can be Staff, Manager or Admin.
- Stamp: the record added to a customer's card for a purchase at a business.
- Gift: the reward set by the business, held for the customer when a card fills up.
- Stamper: the NFC tag placed at the branch that opens the card when touched to a phone.
- Dashboard: the business's management screen at tapiko.app/dashboard.
3. Tapiko's role
Tapiko is a software service that lets businesses run a digital stamp card program. The business designs its card, the customer collects stamps with their phone, and when the card is full the customer receives the gift the business set.
The reward itself is the business's promise, not ours. Treating a customer to a coffee is a matter between the business and its customer; we only keep the count and the record. The business is responsible for the quality and price of what it sells and for handing over the reward.
4. Accounts and security
- Accounts are opened with Apple, Google or a phone number. Each account belongs to one person and cannot be transferred.
- You must be at least 18 to use the Platform.
- You are responsible for the accuracy of the information you give and for keeping it up to date.
- You are responsible for actions taken on your account. Do not share the Apple or Google account or the phone you sign in with; if something looks suspicious, write to us at once.
- When you sign in with Apple or Google, those services' own terms also apply; their passwords never reach us.
5. Stamps are not money
Stamps and gifts can be used only at the business concerned, on that business's terms. They cannot be exchanged for cash, sold, or transferred to another person or to another business's card, and they are not a receivable or electronic money.
6. How stamps are earned
- By tapping the stamper: while signed in to your account and near the branch, you touch your phone to the stamper. Your browser asks permission for the location check. Each tap is one stamp; a waiting period applies to stop repeated stamps on the same card in quick succession.
- By QR code: staff scan the short-lived, rotating QR code on your phone, or you scan the single-use QR code shown on the shop's screen. For several purchases, staff choose how many stamps to give.
- A business may also give extras such as a birthday gift or a bonus stamp for following it on social media; these are the business's choice.
7. Fake and unauthorized actions
Stamps are earned only for a real purchase. Trying to get around the location check, to receive stamps or gifts in someone else's name or with someone else's account, to copy or reuse QR codes, or to take a stamper from its place and use it elsewhere is prohibited. Fake or incorrect stamps and gifts that are detected may be cancelled, and the account may be suspended.
8. Gifts
- When a card fills up, a gift is held on your card. To use it, open the gift in My cards, press "Use" and tap the stamper; or staff scan your QR code. A gift can be used only at that business.
- A business may change its card rules (how many stamps earn a gift, and what the gift is) going forward. The business agrees not to take back gifts a customer has already earned or stamps they have already collected.
- If a business closes, leaves the Platform or does not hand over a gift, the customer's claim regarding the gift is against the business. Tapiko is not obliged to pay the value of a gift.
9. Correcting incorrect actions
We may correct or reverse a stamp or gift recorded incorrectly because of a technical error, a fake action or a staff mistake. If you think your record is wrong, write to the business first, then to us.
10. Business account
- A business account is opened at tapiko.app; branch, card and stamper details are managed from the dashboard.
- The business decides the role (Staff, Manager, Admin) of the people it invites to the dashboard and is responsible for the stamp, gift and settings actions taken with their accounts.
- The moment you remove a staff member from the business, their access to the dashboard and their ability to give stamps end.
- The business is responsible for the accuracy of its branch details (address, location, opening hours, social media accounts). A branch with a wrong location cannot give stamps by stamper.
11. Obligations of the business
- To hand over the gift promised on the card to a customer whose card is full;
- To give stamps only for a real purchase and not act on a customer's behalf without their knowledge;
- To use the customer data seen in the dashboard only for its own loyalty program, in line with the KVKK, and not transfer it to another system;
- To be responsible for the content of the announcements it sends and their compliance with commercial messaging law;
- Not to use misleading or unlawful content, or content that infringes others' rights, in rewards and announcements;
- Not to give stamps or gifts in exchange for a Google review (Google's rules prohibit it, and the Platform does not allow it).
12. Discover and the shop page
Branches with an active subscription, a selected location and at least one stamp given are listed publicly on tapiko.app/kesfet and on their own shop page, unless the business turns this off on the Branches page. These pages show the branch's name, address, opening hours and card, and its Google rating with its source. No customer information is shown.
13. Free trial and subscription
- New businesses start with a 30-day free trial. We do not ask for a credit card for the trial, and it does not turn into a paid subscription by itself.
- The subscription fee is published on the pricing page, includes VAT and is per business. Businesses with more than one branch receive a separate Enterprise quote.
- Payment is made by card through the licensed payment institution PayTR; the subscription renews every month on the same card.
- If we change the price, we notify you by email at least 30 days before it takes effect; a period already paid for is not affected. If you do not accept the new price, you can cancel your subscription.
- Invoices for payments are issued in line with the law, based on the billing details you provide.
- You can cancel at any time; the service continues until the end of the paid period. Details: Delivery, Cancellation and Refunds, Distance Sales Agreement.
14. If your subscription ends
When your subscription ends, your branch is removed from Discover, birthday gifts stop, and we may restrict the dashboard's reporting sections; you can restart your subscription from the dashboard at any time. Your customers keep collecting stamps and do not lose the rewards they have earned. We do not cancel a gift in a customer's pocket because a business is late paying us.
15. The stamper
- The stamper kit sent at setup is free and stays with you even if you cancel your subscription.
- A stamper carries only a link and is locked. If you prepare a stamper yourself from the dashboard, locking it after writing is your responsibility: an unlocked tag can be rewritten by someone else with a different link.
- You must disable a lost, stolen or tampered-with stamper from the dashboard immediately.
- We are not responsible for stamps given with a stamper before it was disabled.
16. Unacceptable use
- Trying to enter stamps that did not happen, imitating or reusing stamp codes, or trying to get around the location check.
- Trying to access another business's or customer's data.
- Testing the Platform's security, probing for weaknesses or trying to reverse-engineer it (reporting a vulnerability you find to us is welcome).
- Overloading the Platform with automated tools, scraping data or opening fake accounts.
- Using the Platform for unlawful or misleading purposes, or in a way that infringes others' rights.
If these are breached, we may suspend or close the account.
17. Your content and the licence you grant
Content a business uploads to the Platform — such as its logo, branch name, card colour, reward text and announcement text — belongs to the business. The business declares that it has the right to use this content and that it does not infringe the rights of third parties.
The business grants us a free, non-exclusive licence to use, reproduce and format this content for the purpose of providing the Platform — to show it on customers' cards, Apple and Google Wallet passes, announcements, Discover and the shop page — for the duration of the subscription, and afterwards for content already sent to customers during that time. We use the business's name or logo in our own promotion only with the business's separate permission.
18. Intellectual property and feedback
The Tapiko name, logo, mascot, and the Platform's software and design belong to us; these terms give you only the right to use the Platform for its intended purpose. We may use suggestions and feedback you send us to improve the Platform without any obligation to you.
19. Third-party services
The Platform uses Apple and Google for sign-in, PayTR for payments, Google Maps for branch search, and Apple and Google for Wallet passes. We are not responsible for the consequences of these services' outages or their own terms, unless we are at fault.
20. Interruptions and changes
We try to provide the Platform without interruption but do not promise 100% availability. Interruptions may occur for maintenance, provider failures or reasons beyond our control. We may develop, change or remove features; if we remove a material feature a business uses, we give notice in advance.
21. Closing an account
- A customer can delete their account from the Profile page at any time (see Account Deletion). Stamps and pending gifts on a deleted account can no longer be used.
- A business's Admin can delete the business from the dashboard. Deletion cannot be undone; the business's branch, card and customer records are deleted, and customers' cards and pending gifts at that business close too. Accounting records the law requires us to keep are kept for the legal period.
22. Suspension and termination
We may suspend or close an account for a serious or repeated breach of these terms, fake actions, a security risk or a request from a competent authority. Where possible, we warn you first and give our reasons.
23. Limitation of liability
The Platform is provided "as is". To the extent permitted by applicable law, we are not liable for indirect damages such as loss of profit, customers or data; our total liability to businesses is limited to the amount paid to us in the 12 months before the event. Our liability for intent and gross negligence, and your rights under consumer law, are unaffected.
24. Force majeure
We are not liable for failing to perform our obligations during events beyond our control, such as natural disasters, epidemics, war, widespread internet or power outages, cyber attacks, failures of infrastructure providers and decisions of authorities.
25. Notices
We send notices to the email address registered to your account or within the Platform. For notices to us, info@tapiko.app and the postal address below apply.
26. Changes to these terms
We may update these terms. We announce material changes by email or within the Platform before they take effect; continuing to use the Platform after a change means you accept the new terms. If you do not accept them, you can close your account.
27. Evidence
In disputes arising from these terms, Tapiko's database, server and transaction records constitute evidence under Article 193 of the Code of Civil Procedure; your right to present counter-evidence is reserved.
28. Other provisions
- If a provision of these terms is held invalid, the other provisions remain in force.
- Not exercising a right does not mean we waive it.
- A business may not transfer its rights and obligations under these terms without our written permission; we may transfer ours in a merger or transfer of the business.
29. Governing law and disputes
These terms are governed by the laws of the Republic of Turkey. Users acting as consumers may apply, within the monetary limits, to the Consumer Arbitration Committees and Consumer Courts where they live or where the transaction took place. For disputes with businesses, the courts and enforcement offices of İstanbul (Anadolu) have jurisdiction.
